  1. For the purpose of this document Down Under Consultants P/L trading as Celestial Enterprises is hereinafter referred to as the "provider" and the Client hereinafter is referred to as the "user".
  2. The use and protection of this system is everyone's responsibility.
  3. The duration of Celestial Enterprises' subscriptions indicates the numbers of days that the user account is active. The account is deemed to have become active when the account is created or renewed.
  4. The Internet contains many forms of electronic material and subject matter. If the user is under 18 years of age, then it will become necessary for the parent/guardian to control what material and subject matter the user is allowed to access. The provider cannot be held accountable for policing the subject matter viewed by the user.
  5. If access, link, etc, problems should occur at Celestial Enterprises, these problems will only be resolved outside the administrators existing working hours. The provider apologises in advance for any inconvenience this may cause.
  6. If the administrators are advised or have reason to suspect (directly or indirectly) that criminal activities are taking place via a user account at Celestial Enterprises, the administrators hold the right to refer the matter to the appropriate authorities.
  7. Deliberately altering or erasing files on Celestial Enterprises system, or any other, that does not belong to you is a criminal offence. Legal action, either criminal or civil, will be taken against those who breach this condition of use.
  8. Deliberately accessing or attempting to access a user account on this system, or any other, that does not belong to you is a criminal offence. Legal action, both criminal and civil, will be taken against those who breach this condition of use.
  9. Deliberately assigning out your password to another to access your user account, is considered to be in violation of Celestial Enterprises' terms and conditions of use. Violation of this condition will make you solely responsible for any actions, including criminal offences, that may take place via your user account. The users account is non-transferable without the express consent of the provider.
  10. The provider hereby grants user accounts to contain a maximum of 2 MByte of data under their existing user account. Celestial Enterprises understands that many of the data archived programs available these days are much larger than the 2 MByte of data user account limit. If a user experiences this problem, then Celestial Enterprises temporarily grants the user an increase of the user account data limit, to a maximum of what is required to temporarily house the archive (singular) required by the user, for a maximum of 5 days or until hard disk drive space becomes scarce (which will be determined by the administrator.)
  11. Celestial Enterprises will not host or store any electronic data that is considered offensive, obscene or pornographic. The provider reserves the right to censor or remove any electronic data that does not comply to this condition.
  12. The provider will not be held liable whatsoever for any loss of electronic data (files, email, etc) or even the legality, or otherwise, of the electronic data stored at Celestial Enterprises for users. All users must note that Celestial Enterprises is an Internet Access Gateway, and not a storage site for electronic data, etc. The user is at all times responsible for their own electronic data. The provider whilst paying all due care and attention will not be held responsible for loss of data resulting from its own negligence or that of its agents.
  13. All users holding a user account at Celestial Enterprises must remember to regularly log in and perform general housekeeping, i.e. unanswered email builds up, and takes up valuable disk space that needs to be shared by all users. Also deleting/removing any files that are no longer required for use under your account is mandatory.
  14. The provider reserves the right to terminate any user in breach of the above conditions at will.
  15. The provider will terminate or suspend access to any user whose credit expires and is not renewed within 7 days.
  16. The user agrees to indemnify the provider against any and all legal action resulting from the unlawful conduct of the user.
  17. The administrators of Celestial Enterprises reserves the right to vary these terms and conditions from time to time without prior warning. Celestial Enterprises will attempt to inform users in advance of any proposed changes.
  18. Further Information Regarding Passwords:
  19. If you feel that your password has become known without your knowledge or that someone is trying to access your user account, change your password immediately. Also, notify the administrators, who can then investigate the situation.
  20. Forgotten or need to change your password? You will need to contact the administrators who will re-enter a new password supplied by you. You will need to provide some identification to ensure this is not a system attack.
  21. To enhance the providers' system and user accounts security, select a password that has no real meaning. It should be obscure enough to prevent even your best friends from guessing. A string of unrelated words and numbers or even misspelled words are quite secure and easy to remember.
